lyfvault Terms of Service

1. Service Scope

lyfvault provides encrypted storage tooling, trust scoring, session controls, notifications, recovery workflow controls, and related digital identity and security features. lyfvault may help users organize private information, designate recovery contacts, define workflow conditions, and manage secure release procedures.

lyfvault does not guarantee the legal validity, enforceability, or effectiveness of any user instruction, beneficiary designation, executor designation, trustee designation, recovery configuration, digital inheritance instruction, or release workflow.

2. Eligibility And Account Responsibility

You may use lyfvault only if you are legally permitted to do so under applicable law. You are responsible for maintaining the confidentiality of your credentials, devices, passphrases, one-time codes, and recovery materials, and for all activity that occurs under your account except to the extent caused directly by lyfvault's proven breach of these Terms.

You must provide accurate information for your account and recovery workflows and keep it current. You must not impersonate another person, misstate authority, or submit recovery claims or beneficiary information that you are not authorized to provide.

3. Your Content, Instructions, And Recovery Designations

You retain responsibility for the legality, accuracy, completeness, and enforceability of all information, instructions, documents, secrets, beneficiary designations, recovery settings, executor details, trustee details, and other content that you submit to or manage through lyfvault.

You represent that you have the rights and authority needed to submit that material and to name any beneficiaries, executors, trustees, or other contacts. You are solely responsible for ensuring that your use of lyfvault is consistent with your estate plan, fiduciary arrangements, employment obligations, confidentiality obligations, and applicable law.

4. Recovery Workflows And No Guarantee Of Legal Entitlement

Recovery workflow states, including pending, delayed, hold, dispute, review, release candidate, shard threshold, beneficiary vote, executor confirmation, trustee approval, and related statuses, are platform controls only. They do not by themselves establish death, incapacity, legal entitlement, ownership, succession rights, fiduciary status, or authority to receive assets, credentials, or confidential information.

Inactivity, silence, loss of access, or a recovery trigger does not by itself prove death, incapacity, or legal entitlement. lyfvault may request additional evidence, documentation, approvals, waiting periods, or manual review before permitting any recovery step or release workflow action.

Local law, court orders, probate rules, trust instruments, employment duties, and third-party platform terms may override or limit the effect of any lyfvault workflow. You are responsible for obtaining legal advice where needed.

5. Security, Monitoring, And Communications

lyfvault may use session controls, device continuity checks, risk scoring, notifications, rate limits, audit logging, and other security measures to protect accounts and workflows. Some features may depend on device, browser, network, or email-provider behavior and may be unavailable in some contexts.

You agree that lyfvault may send service, security, sign-in, recovery, and workflow notifications to the contact details associated with your account or recovery configuration. Delivery timing and inbox placement depend on third-party providers and are not guaranteed.

6. Prohibited Use

You may not use lyfvault to violate law, infringe rights, impersonate others, interfere with platform security, attempt unauthorized access, test or reverse engineer protected systems without authorization, submit false recovery claims, or store or distribute material that you do not have the right to use.

7. Suspension, Restriction, And Termination

lyfvault may suspend, restrict, delay, review, or terminate access where it reasonably believes this is necessary for security, fraud prevention, abuse prevention, dispute handling, legal compliance, policy enforcement, or protection of users and third parties.

lyfvault may place a recovery workflow or release process on hold where evidence is incomplete, conflicting, suspicious, or legally uncertain.

8. Availability And Changes

lyfvault works to provide a reliable service, but does not guarantee uninterrupted, error-free, or continuously available access. Maintenance, third-party outages, security events, legal restrictions, or technical failures may affect availability, delivery timing, workflow timing, or feature access.

lyfvault may modify, improve, suspend, or discontinue features from time to time, including security checks, recovery controls, notification flows, and user interfaces.

9. Privacy

Use of lyfvault is also subject to the Privacy Notice and Recovery Disclosures. Where lyfvault processes personal data, it does so subject to applicable data protection law and the product disclosures made available by Zandekha Technologies.

10. Intellectual Property

lyfvault, its software, branding, interfaces, documentation, and related materials are owned by or licensed to Zandekha Technologies and are protected by intellectual property laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the service in accordance with these Terms.

11. Disclaimers

To the fullest extent permitted by law, lyfvault is provided on an "as is" and "as available" basis. Zandekha Technologies disclaims warranties, representations, and guarantees of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted access, legal enforceability of user instructions, recovery certainty, release certainty, or compatibility with every third-party platform.

12. Limitation Of Liability

To the fullest extent permitted by law, Zandekha Technologies and its affiliates, directors, employees, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, revenue, goodwill, data, digital assets, credentials, business opportunity, or expected inheritance, even if advised of the possibility of such damages.

To the fullest extent permitted by law, the aggregate liability of Zandekha Technologies arising out of or relating to lyfvault or these Terms will not exceed the greater of (a) the amount you paid to lyfvault for the service in the 12 months before the event giving rise to the claim, or (b) USD 100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including mandatory consumer protections.

13. Indemnity

You will indemnify and hold harmless Zandekha Technologies and its affiliates, directors, employees, and contractors from claims, liabilities, damages, losses, and costs, including reasonable legal fees, arising out of or related to your content, your instructions, your recovery designations, your misuse of lyfvault, your violation of these Terms, or your violation of applicable law or third-party rights.

14. Governing Law And Disputes

These Terms are governed by the laws of Malawi, excluding conflict-of-law rules, unless mandatory law in your place of residence requires otherwise. Courts located in Malawi will have exclusive jurisdiction over disputes arising from or relating to these Terms, except where non-waivable consumer law requires a different forum.

If you use lyfvault in connection with an estate, trust, succession matter, or recovery claim involving another jurisdiction, additional local law may apply and may override parts of the workflow or these Terms.

15. Changes To These Terms

Zandekha Technologies may update these Terms from time to time. Updated Terms become effective when posted or otherwise communicated, except where applicable law requires advance notice. Your continued use of lyfvault after the effective date of updated Terms constitutes acceptance of the updated Terms.
